- Only message people who clearly opted in. Honor STOP / unsubscribe immediately.
- Don't run scams, spam, fraud, or anything illegal through MotionOptima.
- Don't try to break, abuse, or scrape the platform.
- If you violate this policy, we may suspend or close your account without refund.
1. About this policy
This Acceptable Use Policy ("AUP") applies to everyone who uses MotionOptima. It is part of our Terms of Service. We may update it as new abuse patterns, regulations, or carrier rules emerge.
2. You're responsible for your messages
MotionOptima sends SMS, MMS, RCS, and email on your behalf, but you are the sender. You are responsible for the content, the recipients, and compliance with all applicable laws in every jurisdiction you operate. That includes, without limitation:
- U.S. TCPA and FCC rules — including prior express written consent for marketing texts.
- U.S. CAN-SPAM Act for commercial email — accurate "from", clear "this is an ad", physical address, and easy unsubscribe.
- Carrier guidelines including 10DLC registration, A2P traffic rules, and the CTIA Messaging Principles & Best Practices.
- CASL in Canada, GDPR in the EEA, the UK PECR, and similar laws elsewhere.
- State telemarketing laws (FL, OK, WA, MD, TX, etc.) including registration where required.
3. Consent and opt-out
- You must have prior express written consent for marketing SMS to U.S. consumers, and a documented record of it.
- Initial messages must include sender identification and clear opt-out language ("Reply STOP to opt out").
- "STOP", "UNSUBSCRIBE", "QUIT", "CANCEL", "END" and similar replies must be honored automatically — MotionOptima handles this for you, and you must not work around it.
- You must keep proof of consent for at least four years and produce it on request.
4. Prohibited content and use cases
You must not use the Service to send or promote any of the following:
- Illegal goods or services, including unlicensed firearms, controlled substances, illegal drugs, and stolen property.
- SHAFT content (Sex, Hate, Alcohol, Firearms, Tobacco) where carrier rules prohibit it without explicit age-gating and registration.
- Phishing, deceptive content, fake job offers, fake invoices, fake delivery notices, "you've won" scams, or impersonation of any business or person.
- Get-rich-quick schemes, pyramid schemes, multi-level marketing solicitations to non-opted-in recipients.
- High-risk financial products without proper licensing — payday loans, debt-relief, cryptocurrency speculation, gambling, and similar.
- Unapproved pharmaceuticals, supplements with unsubstantiated claims, or medical advice you are not licensed to provide.
- Adult content, child sexual abuse material (zero tolerance — we report to NCMEC and law enforcement), or any sexual content sent to recipients without explicit opt-in.
- Hate speech, harassment, threats, doxxing, or content that incites violence or self-harm.
- Political content where prohibited by carrier or law without proper registration and disclosures.
- Misinformation about elections, public health, or emergencies.
5. Technical abuse
You must not, and must not allow anyone to:
- Send messages to lists you bought, scraped, or otherwise sourced without consent.
- Use multiple accounts to evade limits, suspensions, or carrier rules ("snowshoeing").
- Run open-ended bulk loads that bypass the AI's compliance checks.
- Reverse-engineer, decompile, or scrape the Service or its content.
- Probe, scan, or test the vulnerability of any system without our prior written authorization. Responsible-disclosure reports are welcome at [email protected].
- Interfere with rate limits, queueing, or other abuse-prevention systems.
- Upload malware, trojans, or content that exploits a security flaw.
6. AI use
- You are responsible for AI output before it goes to a recipient.
- Don't use the AI to impersonate a specific real person or to generate content that violates Section 4 above.
- Disclose AI use where required by law (e.g., California's bot-disclosure law).
- Don't claim AI-generated text or media is something it isn't — for example, framing AI output as a quote from a real medical professional.
7. Customer end-users
If you allow team members or contractors to use your account, you are responsible for their actions. Make sure they understand and follow this AUP.
8. Reporting abuse
To report a violation of this AUP — for example, unwanted messages from a MotionOptima customer — email [email protected] with the message details. We investigate every report.
9. Enforcement
If we believe your use violates this AUP, we may:
- Ask you to stop and give you time to fix the issue.
- Throttle, block, or remove offending messages, campaigns, or assets.
- Suspend or terminate your account, with no refund, for serious or repeated violations.
- Cooperate with carriers, ad platforms, regulators, and law enforcement as required.
For violations that risk immediate harm or legal exposure (CSAM, large-scale fraud, mass spam), we may act without prior notice.
10. Indemnification
You agree to indemnify MotionOptima for any third-party claims, fines, penalties, or losses arising from your violation of this AUP — for example, TCPA settlements caused by your messages or your data.
